Event Client Contract

 

Principal Activity to be conducted on the Premises

Sunny Rays™ Pty Ltd is a Caterer of food and beverage services (along with the coordination of 3rd party entertainment and hire services) located on the Sunshine Coast in Queensland, Australia.

 

Maximum Hours of Operation

Sunny Rays™ Pty Ltd operates events from 6am to midnight, 7 days per week. The business is usually closed by 10pm, unless there is a specific function, event, market, or festival booked. Liquor trade will only be conducted within the current licensed trading hours for Sunny Rays™ Pty Ltd respectively between 10am and Midnight.

 

Details of Responsible Service of Alcohol (RSA) Initiatives

All staff employed by Sunny Rays™ Pty Ltd in the capacity of serving drinks are informed via the staff handbook and contract of the policies in relation to the serving of alcohol. The policies are primarily in line with the RSA guidelines. The policy in relation to RSA issues is to empower all our staff to ask for ID and suspend or cut off service should they have any concerns. All employees’ RSA, RMLV, Food Safety Supervisor Certificates and additional credentials are kept in the Training Register upon request of the client.

 

Arrangements at the Premises with Respect to:

Lighting

Sunny Rays™ Pty Ltd requires adequate lighting at its entrances and exits and around its external areas of the event space. These lights must be operational from dusk until the completion of any event. In the case of operations prior to sunrise, these lighting procedures should operate from the commencement of operations until dawn.

 

Noise

To ensure Sunny Rays™ Pty Ltd meets its license obligations in respect to noise, Sunny Rays™ Pty Ltd uses a Decibel reader in relation to its services throughout the event. Management monitor and record any live entertainment or other noise on the premises in the Decibel Reader Register and store it on file. Sunny Rays™ Pty Ltd catering does not take responsibility for any noise complaints made on the property. It is the client’s responsibility to manage noise levels and complaints by notifying neighbours ahead of time and offering their best form of contact to address issues to during any event. The client is also responsible for the noise levels of all guests whilst departing the premises of the event.

 

Security

Sunny Rays™ Pty Ltd policy regarding catering functions and events over 50 people is that a client must also pay for one registered security officer for the duration of their function and one hour after its completion. Should a function or event hold more than 100 people, the client must pay for one or more additional security officers for every 50 people, thereafter.

 

Transport Services

Sunny Rays™ Pty Ltd encourages the safe arrival and departure of its patrons and staff via their own means and encourages best practice of managing transportation safety. Staff are trained to call taxis for patrons on request and encourage patrons to use alternative forms of safe transport if they have consumed liquor.

 

Provision of Food

Sunny Rays™ Pty Ltd offers customised menus and function structures to all its patrons, focusing on the foundational operations of food and beverage packages. These menus can vary from canapé & bamboo box standing services to multiple dining courses inclusive of occasion cakes and grazing boards. Should a patron require liquor during their event, Sunny Rays™ Pty Ltd will supply a higher quantity and substance of food to encourage RSA (i.e., grazing boards are not a sufficient meal to par with a cocktail bar service).

 

Waste Management

All general waste, recycling (both glass, plastic and/or cardboard) and compost where available is to be stored on-site in allocated bins for each specific type of waste at the Private Residence or Corporate/Industrial Site of any given event until removal by local Council Waste Services. Sunny Rays™ Pty Ltd does not provide external wastage services for an any event.

 

Staff Training

Sunny Rays™ Pty Ltd conducts staff training on a regular basis and all new employees are also inducted using the employee induction checklist, highlighting basic RSA, safety, MSDS and fire protocols. It is also a condition of employment that employees involved in the service of food and beverage to patrons hold a current RSA certificate that is held on file under the Training Register. All relevant updates to Federal, State and Local law are communicated to the staff prior to any event.

 

Dealing with Minors on the Premises

Dealing with minors on the premises is part of the in-house and official RSA training. All staff know that any minor should be supervised and accompanied by an adult who is a parent or responsible adult. Minors are not permitted to request drinks or service at any bar. To be considered an exempt minor (not having a responsible adult or parent present) by having a meal, the minor/s are permitted to attend the event but are required to leave once the meal is finished. A meal is not considered to be grazing board items, a smoothie, fries or coffee and cake etc.

Furthermore, staff are trained to request proof of ID whenever they suspect the person may be under the age of 25. Policies dealing with fake ID issues are in place under the Office of Gaming and Liquor Regulations (OLGR), and staff know to advise management of any issue immediately for reporting to the relevant authorities. It is illegal for any person to supply a minor with liquor, and there are no exceptions.

Any patron or staff member caught supplying a minor with liquor will be asked to vacate the premises immediately, inclusive of the minor. Safe transport will be arranged if necessary. Any minor caught with liquor will be asked to vacate the premises, and the parent and/or responsible adult they attended with will be notified to assist them to vacate the premises.

 

Dealing with Unduly Intoxicated and/or Disorderly Patrons on the Premises

Staff of Sunny Rays™ Pty Ltd are trained and reminded of their RSA responsibilities in relation to unduly intoxicated and/or disorderly patrons. Unduly intoxicated and/or disorderly patrons are not permitted to request drinks or service at any bar. Staff also are trained to report any disorderly patron issues to management immediately.

Should an unduly intoxicated patron be in possession of liquor, management will coordinate with them by removing any liquor available and offering non-alcoholic substitutions for the remainder of the event. Should any disorderly patron be in possession of liquor, management will coordinate with them by removing any liquor available, and if disorder continues, will be asked to vacate the premises and safe transportation will be made available.

 

How the Impact of the Business on the Amenity of the Community will be Limited

On occasions that Sunny Rays™ Pty Ltd have a function finishing at midnight, management advise that the hired security is standing at the roadside entrance to safeguard that noise and behaviour is kept at an appropriate level. Management can also call multiple taxis at the end of a function to assist in dispersing crowds as soon as possible. Waste from the event is kept in a specific closed off area, and quietly moved into council bins.

 

Ensuring the Conduct of Business at the Premises Complies with the Act and other Laws

Management have utilised the services of the OLGR to assist Sunny Rays™ Pty Ltd in meeting all its responsibilities under the Liquor Act 1992 and Liquor Regulations 2002.

  • Footpath Dining – All events, catering and functions will not be held on council footpaths, unless special permission is granted for certain markets and festivals.
  • Designated Outdoor Smoking Area (DOSA) – All operations of Sunny Rays™ Pty Ltd set designated areas for the consumption of tobacco and other smoking products and sets standards required by law in relation to maintaining these areas and to the location regarding the mobile commercial kitchen.
  • Advertising of events – Management does advertise on occasions for specific events and is aware of the restrictions in relation to advertising alcohol directly and indirectly.
  • Number of patrons on premises – The business abides by the relevant Fire Safety Regulations regarding the number of patrons allowed on the premises at any given time.
  • Adult entertainment – Sunny Rays™ Pty Ltd does not participate in or practice adult entertainment.
  • Functions and Catering Off-Site – The business follow RSA and service criteria for all functions, catering and events under the relevant laws and regulations. Function bookings are essential and conditional on a this signed agreement with the client in respect to RSA guidelines is in conjunction with the RAMP.

 

LATE OR NO FINAL PAYMENT POLICY

Your Final Payment is the outstanding amount due after any deposit has been made. Should your Final Payment (generally due 14 days or more prior to the event date) be made less than 8 days prior to the event date as a late payment, an additional 10% Late Payment Fee of the entire event cost of your event will be added to your Final Invoice for payment due prior to the event. Should no final payment be made less than 8 days prior to the event date, your event may be forfeited in entirety and be referred to our Cancellation & Refund Policy.

 

CANCELLATION & REFUND POLICY

The Terms of Use are between Sunny Rays™ Pty Ltd and you (The Client). By using our services, you agree to be bound by these terms. If you do not wish to be bound by the terms of this agreement, you must contact Sunny Rays™ Pty Ltd to discuss. You may use our services as set out in the terms.
Our Policy:

  • A 50% deposit is required upon the acceptance of the final agreed quote to secure the proposed date and booking. Final numbers of guests and other information is required no later than 14 days prior to the event date. An updated invoice reflecting deposit paid and final numbers will be issued to you 14 days prior to the event, requiring payment as soon as the invoiced has been received.
  • Any Cancellation or Reschedule made less than 14 days prior to the event date, or Late or No Final Payment made less than 8 days prior to the event date will not incur a refund (inclusive of unforeseeable disaster, Covid19 outbreaks and/or personal circumstances). A fee of 10% of the total and final invoice, inclusive of Late or No payment fees, will be taken due to loss of time in preparation of your event, and potential loss of additional events that may have been held that day in lieu of your event. The remaining amount paid, or a portion thereof, may be available as a credit to future events minus the expenses incurred to Sunny Rays™ Pty Ltd (receipted by third parties for loss of stock, pre-paid staff etc). We can offer a reschedule of your event for another time and date that is convenient to both Sunny Rays™ Pty Ltd and you (The Client). Extra payments may be required for the future event. Any future event must be within 6 months of the original event date. If this is not possible, 100% of your payment will not be refunded.
  • If you cancel more than 14 days prior to your event date, we will refund any amount paid to Sunny Rays™ Pty Ltd minus expenses made in preparation for your event (receipted by third parties for loss of stock, pre-paid staff etc). In most cases, the amount paid will be the 50% deposit to secure the date and booking. Alternatively, we can offer a reschedule of your event for another time and date that is convenient to both Sunny Rays™ Pty Ltd and you (The Client).
